TERMS AND CONDITIONS
Effective: 1 January 2026
These Terms and Conditions (“Terms”) govern access to and use of the BusLink Botswana platform (“BusLink”), operated by Aloracras Solutions (“the Company”, “we”, “us”, or “our”). By accessing or using BusLink, you agree to be legally bound by these Terms. Parties unable to comply with the Terms and Conditions as set below may be prohibited from BusLink.
These Terms shall be interpreted in accordance with the laws of the Republic of Botswana, including the Consumer Protection Act, the Road Traffic Act, the Botswana Data Protection Act 2024, and applicable electronic communications legislation.
1. NATURE OF THE SERVICE
BusLink is an online technology platform that facilitates the listing, discovery, booking, and payment of bus transport services offered by independent third-party operators. Buslink is the sole technological intermediary and facilitator on its Platform
The contract of carriage is concluded directly between the Passenger and the relevant bus operator upon confirmation of a booking. BusLink is not a party to that contract.
BusLink makes no representation or warranty regarding the quality, safety, legality, fitness for purpose, or reliability of any transport service offered by operators on the platform.
The platform is provided on an ‘as is’ and ‘as available’ basis. The platform may not be uninterrupted, error-free, or available at all times due to circumstances out of the control of BusLink.
2. ELEGIBILITY AND ACCOUNT REGISTRATION
- Users must be at least eighteen (18) years of age or use the platform under the supervision and consent of a parent or legal guardian.
- Users agree to provide accurate, current, and complete information when creating an account or making a booking.
- The Company reserves the right to suspend or terminate accounts where false, misleading, or incomplete information is provided, or where the Company suspects fraudulent conduct.
- Operators must possess all valid licences, permits, and regulatory approvals required under the Road Traffic Act (Botswana) and related regulations. Listing on BusLink does not constitute verification or endorsement of an operator's compliance status.
- Users are responsible for maintaining the security and confidentiality of their account credentials. BusLink is not liable for any loss or damage arising from unauthorised access to a user's account where the user has failed to take reasonable precautions.
- One person or entity may only hold one active account on the platform. Creating multiple accounts to circumvent restrictions is prohibited.
3. BOOKINGS AND PAYMENTS
- All prices are displayed and processed in Botswana Pula (BWP).
- Payments may be made through authorised payment methods, including Visa, Mastercard, and approved mobile money services.
- A booking shall only be deemed confirmed upon: (a) successful payment; and (b) issuance of a booking confirmation via SMS or email.
- Ticket prices are determined by operators and may change at any time prior to checkout. The price displayed and confirmed at the point of payment shall be the final binding price for that transaction.
- BusLink charges a platform service fee per transaction, which shall be disclosed to the passenger prior to payment. This fee is non-refundable except where a trip is cancelled by the operator.
- BusLink does not guarantee seat availability until payment is successfully completed and booking confirmation is issued.
- BusLink acts as a payment collection agent on behalf of operators and is not responsible for the underlying transport service. A successful payment to BusLink does not guarantee the quality, timeliness, or provision of the transport service.
- BusLink shall not be liable for payment failures, delays, or errors caused by third-party payment processors, mobile money operators, banking systems, or network connectivity issues beyond BusLink's control.
4. CANCELLATIONS, REFUNDS, AND REBOOKING
- Refund eligibility shall be determined as follows:
- The BusLink service fee is non-refundable in the instance of a refund.
- In the instance a refund is requested with more than 24 hours to departure time, the Passenger is eligible for full compensation of the ticket price.
- In the instance the refund is requested 12 to 24 hours of the Departure time, the Passenger is eligible for 80 % of the ticket price.
- In the instance the Passenger requests a refund less then 12 hours from the departure time, the Passenger is not eligible for a refund. Rebooking may be available at the discretion of the Operator.
- Where no refund is available, the Passenger may request rebooking for a later trip on the same route within thirty (30) days, subject to operator approval and availability.
- Where a trip is cancelled by the operator, the Passenger shall be entitled to a full refund, including any service fees paid. BusLink's sole obligation in this regard is to facilitate the refund process; recovery of the refund amount from the operator is a matter between BusLink and the operator.
- Refunds shall be processed within five (5) to seven (7) business days to the original method of payment. Processing timelines may be extended by the applicable payment gateway or mobile money operator, for which BusLink accepts no liability.
- BusLink reserves the right to decline a refund request where the Passenger has engaged in fraudulent, abusive, or dishonest conduct in connection with the booking or refund request.
- These provisions are subject to applicable rights under the Consumer Protection Act (Botswana), which shall prevail in the event of conflict.

5. PASSENGER RESPONSIBILITIES
Passengers agree to:
- Arrive at the designated departure point at least fifteen (15) minutes prior to the published departure time.
- Present valid booking confirmation (digital or printed) at boarding.
- Carry valid identification (National Identity Card or Passport) when required.
- Comply with all operator rules and instructions, including baggage limitations, safety instructions, and conduct requirements.
- Ensure appropriate tickets are purchased for accompanying children where applicable.
- BusLink and operators shall not be liable for missed departures resulting from the Passenger's delay, failure to comply, or late arrival.
- Passengers agree not to make false, abusive, or misleading reviews or complaints against operators or BusLink.
- Passengers agree to treat operators, drivers, and BusLink staff with respect and dignity. Abusive conduct may result in account suspension.
6. OPERATOR OBLIGATIONS
Operators using BusLink agree to maintain valid licences, roadworthy certification, insurance, and regulatory approvals; ensure vehicles are not overloaded; honour all confirmed bookings except for lawful and reasonable cause; and provide accurate service information. The Company reserves the right to suspend any operator found to be in breach of applicable laws or these Terms.
7. USER INDEMNITY
Each User (whether Passenger or Operator) agrees to indemnify, defend, and hold harmless Aloracras Solutions, its directors, employees, contractors, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) the User’s use of or access to the platform; (b) any breach by the User of these Terms; (c) any violation of applicable law by the User; or (d) any dispute between the User and a third party (including another operator or passenger) in connection with the platform.
8. LIMITATION OF LIABILITY
- To the fullest extent permitted by applicable law, BusLink shall not be liable for:
- Delays, cancellations, accidents, injuries, or deaths arising from transport services provided by operators:
- Loss, theft, or damage to luggage or personal belongings.
- Service disruptions caused by events beyond reasonable control, including natural disasters, strikes, government action, infrastructure failures, or third-party system outages.
- Any act, omission, negligence, or misconduct of any operator, driver, or third party.
- Platform downtime, unavailability, errors, or technical failures.
- Loss of bookings, data, or revenue resulting from platform disruptions or third-party failures.
- BusLink's total aggregate liability to any User in respect of any claim arising from the use of the platform shall not exceed the total amount paid by that User for the specific booking, giving rise to the claim.
- BusLink shall not be liable for any indirect, incidental, special, consequential, punitive, or economic loss, including loss of profit, loss of revenue, loss of data, or loss of goodwill.
- Nothing in these Terms shall exclude or limit any rights afforded to consumers under applicable Botswana law, including the Consumer Protection Act (Botswana).
9. THIRD-PARTY SERVICES AND LINKS
- The platform may integrate with or link to third-party services, including payment gateways, mobile money operators, mapping services, and communications providers. BusLink is not responsible for the availability, accuracy, or conduct of any third-party service.
- Users' interactions with third-party services are governed by those parties' own terms and conditions. BusLink accepts no liability for third-party service failures, outages, or errors.
10. PROHIBITED USE
Users shall not:
- Resell or transfer tickets for commercial gain without prior written authorisation from BusLink.
- Provide false or misleading identity information when creating an account or making a booking.
- Use the platform for unlawful, fraudulent, or abusive purposes.
- Interfere with, disrupt, or attempt to gain unauthorised access to the platform or its systems.
- Attempt to reverse-engineer, copy, or reproduce any part of the platform's software or design.
- Use bots, scrapers, or automated tools to access or extract data from the platform.
- Post false, misleading, defamatory, or abusive reviews or content on the platform.
- The Company reserves the right to suspend or terminate access for violations of this clause, without prior notice and without liability.
11. INTELLECTUAL PROPERTY
- All content, trademarks, software, design elements, and intellectual property on BusLink are the property of Aloracras Solutions or its licensors and are protected under applicable intellectual property laws of Botswana.
- No content may be copied, reproduced, distributed, modified, or used for any commercial purpose without the prior written consent of Aloracras Solutions.
- Users grant BusLink a non-exclusive, worldwide, royalty-free licence to use any reviews, feedback, or content submitted to the platform for the purposes of operating and improving the service.
12. PLATFORM AVAILABILITY
- BusLink does not guarantee uninterrupted access to the platform and shall not be liable for any loss or damage caused by temporary or permanent unavailability.
- BusLink may suspend, modify, or discontinue the platform or any feature at any time, with or without notice, and shall not be liable to any User for doing so.
13. FORCE MAJEURE
BusLink shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay is caused by circumstances beyond BusLink’s reasonable control, including but not limited to: acts of God, natural disasters, floods, pandemics, civil unrest, government action, regulatory intervention, power failures, telecommunications failures, or failures of third-party service providers.
14. SUSPENSION AND TERMINATION
- The Company reserves the right to suspend or terminate access to the platform at its sole discretion where: (a) these Terms are breached; (b) fraudulent or unlawful activity is suspected or confirmed; or (c) continued access poses a risk to the platform, its users, or BusLink's interests.
- Termination of access does not affect BusLink's right to pursue any legal remedy for breach of these Terms.
- Users may discontinue use of the platform at any time.
15. AMENDMENTS TO TERMS
- The Company reserve the right to amend these Terms at any time. Updated Terms shall be published on the platform with a revised Effective Date.
- Continued use of BusLink after such amendments constitutes acceptance of the updated Terms. Where changes are material, reasonable notice shall be provided via SMS or email.
- BusLink shall not be liable for any loss arising from a User's failure to review updated Terms following notification.
16. GENERAL PROVISIONS
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
- Entire Agreement: These Terms constitute the entire agreement between BusLink and the User regarding use of the platform.
- Waiver: No failure or delay by BusLink in exercising any right shall constitute a waiver of that right.
- Assignment: Users may not assign any rights or obligations under these Terms without BusLink’s prior written consent. BusLink may assign these Terms to any successor entity.
- No Partnership: Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between BusLink and any User.
17. GOVERNING LAW AND DISPUTE RESOLUTION
- This agreement shall be governed by and construed in all respects in accordance with the laws of the Republic of Botswana and the parties agree to submit to the jurisdiction of the Botswana Courts as regards any claim or matter arising from the agreement.
- Any dispute, controversy, or claim arising out of or in connection with this Agreement shall, in the first instance, be resolved amicably through good-faith negotiations between the Parties. Failing such resolution, the dispute shall be referred to mediation and, if still unresolved, to arbitration conducted within the Republic of Botswana, in accordance with the applicable laws and procedures in force therein
